Bugaboo respects your privacy. This is why we deal carefully with your personal data and process it exclusively in accordance with this privacy statement and national laws and regulations that apply to the processing and security of personal data. This privacy statement applies to the processing by Bugaboo International B.V. (“Bugaboo”/ ”We”) of personal data relating to users of the online Bugaboo Business portal, which may be business owners or representatives of Bugaboo business customers.

 

The controller responsible for data processing in the context of the Bugaboo Business portal is Bugaboo.

 

For which purposes do we use your personal data?

For the conclusion and execution of retail agreements. Bugaboo encloses retail agreements with its business partners (retailers). Retailers with a signed retail agreement can, amongst other things, use the Bugaboo Business Portal and place orders. When you have purchased a product from us through the Bugaboo Business Portal, we process your personal data for administrative purposes such as sending invoices and making payments. We also use your personal data to deliver and administer the products you have ordered. Bugaboo will process your personal data to further execute our agreement, including for the delivery of customer services (e.g., sending delivery status e-mails or to answer questions you may have regarding your purchases).


For this purpose, we process your contact details such as your name, email address, telephone number and order history. We also process your address and payment details when you have provided us with this personal data in your online account.


We have a legitimate interest to process your personal data for the conclusion and execution of the agreement we have with our business partners. We only process the personal data we need for the conclusion and execution of the retail agreement and that you have provided us with. If you do not provide us with personal data which we require at a minimum in order to meet your request or to process your order (as relevant), we may not be able to comply with your request and/or perform our obligations under the contract with you or your company.


We store information about previous orders you have placed on our business portal to provide you customer services. The information helps us to answer any questions you may have regarding your order(s) and to facilitate you when placing new orders.


To administer your account and to ensure confidentiality and security of your purchases. When you choose to register with the Bugaboo Business Portal, you may provide personal data so that we can create an account for you. This enables us to administer your account, to ensure the confidentiality and to maintain the security of your purchases. We are, for instance, able to reset your password for you. We are, however, not able to view your password.


For this purpose, we process your name, email address, any other information you have added to your account, your login data (including your password), display name, the details of your purchases and your or your company’s payment details.


For relationship management and marketing. We process your personal data to send you suitable offers and newsletters. We also use your personal data for the development, execution and analysis of market surveys and marketing strategies.


For this purpose, we process your contact details such as your email address, telephone number, name and order history.


To comply with the law. In some cases, we process your personal data to comply with laws and regulations. This could, for example, be the case where tax or business conduct related obligations apply. In order to comply with relevant laws and regulations, we may have a legal obligation to disclose your personal data to government institutions or supervisory authorities.


For this, we process your contact details such as your email address, name, telephone number, order history, and- if applicable - your payment details and address.


How long do we store your personal data?

Your personal data will be removed and/or made anonymous when your personal data is no longer necessary for the purposes for which these personal data are processed. Your personal data will be stored for as long as necessary to provide the services you have requested. We may also need to store your personal data for when we have a legal obligation or to resolve disputes. In addition to that, Bugaboo will not store your personal data longer than permitted by law.


How long we keep personal data can vary widely depending on the context of the services we offer, our legal obligations and the (local) entity that is processing your personal data. The following criteria are often used to determine the retention period: nature of the personal data, the context in which the personal data have been collected, the consequences for the data subject and the existence of appropriate safeguards (such as pseudonymization).

Who has access to your personal data?

Your personal data can be received by the following categories of recipients:

Group companies. As a global organisation, data we collect may be transferred internationally throughout our worldwide organisation. Your personal data may be exchanged with our group companies working under the name ‘Bugaboo’. We exchange your data for administrative purposes and so that we can have a complete overview of your contacts and contracts with Bugaboo. We may also exchange your data in order to offer you a complete package of services and products. We may share personal data with our group companies for the purpose of providing jointly content and products and/or services, the development of new products, websites, applications, services, tools and communication, and to prevent, trace and examine possible illegal activities, infringements of our policies, fraud and/or breaches of our data security.


Authorities. For example, supervisory authorities, Tax and Customs Administration, police and other statutory bodies. We may provide your personal data:

·      to comply with a statutory obligation or court order;

·      if this is necessary to prevent, trace or prosecute criminal acts; or

·      if this is necessary to enforce our policies, or to protect the rights and freedoms of others.


Business service companies. To provide our services we use third parties. For example, a transportation company which is requested by Bugaboo to deliver the product you have purchased, or an online payment provider to that is requested by Bugaboo to handle online payments. In addition, we also engage third parties such as analytics companies to analyse the data about your website use, to perform possible personalization of the website and communication, and the display of relevant offers and advertisements.


Other. Each third party to which we – with your given consent – provide your personal data (for example within the context of a collaboration), and/ or to which Bugaboo now or in the future forms part of as a result of a restructuring, merger or acquisition. 


Insofar these third parties process your personal data in the capacity of processor for Bugaboo, we enter into an agreement with the processor. In this agreement we include obligations to ensure that your personal data are processed by the processor solely to provide services to us.


Is your personal data being transferred (outside the EU)?

Your personal data may be stored and processed in any country where Bugaboo is located. If required by law, Bugaboo entities operate under EU Standard Contractual Clauses, which provide safeguards for cross-border transfers.


We may share personal data about you with third parties, such as business partners, service providers, and/or vendors who help us execute our business. If your personal data are transferred to a third party in a country that does not provide an adequate level of protection for personal data, we will, where required, take measures to ensure that your personal data are adequately protected.

 

How do we protect your personal data?

We have adopted both technical and organizational measures to protect your data against loss, theft and unauthorized access.


We continually improve our security measures in case of technological advances and developments. We also recommend that you properly and correctly secure your own electronic data carriers.

 

How to exercise your privacy rights and manage your personal data?

You have the right to request access of an overview of your personal data, and under certain conditions, rectification and/or erasure of personal data. In addition, you may also have the right of restriction of processing concerning your personal data, the right to object to processing as well as the right to data portability.
